Attorney’s fees:

There are basically four options for billing. Billing according to a standard rate, individual services, hourly rate (time-based fee) and a flat fee agreement. If billing is based on a standard rate or individual service, the basis of assessment is of decisive importance. This is because it is decisive for the amount of the individual services. The basis of assessment is referred to as the “value in dispute”. The higher the amount in dispute, the higher the lawyer’s fee. As claims are not exclusively monetary claims, the so-called interest is to be assessed with a euro amount. For most matters, the Lawyers’ Fees Act and the General Fee Criteria specify corresponding valuations in euros. If no valuations are specified, the lawyer must value this claim in monetary terms in consultation with the client.


If no fee agreement has been made, a reasonable fee shall be paid. The Lawyers’ Fees Act (RATG), the Notaries’ Fees Act (NTG) and the General Fee Criteria (AHK) are used for this purpose. If billing has been agreed in accordance with the RATG in conjunction with the AHK and/or the NTG, the lawyer is free to choose between billing according to a standard rate or according to individual services.
